Terms of Use
1. Who we are and what these terms cover
NUTclient ("NUTclient", "we", "us") is an independent Minecraft client modification, launcher and online service operated by [Operator name], [Street and number, postal code, city, country]. These Terms of Use (the "Terms") apply to every use of the NUTclient launcher, the NUTclient game modification (the "Client"), the websites at nutclient.roonicstudios.de and api.roonicstudios.de, the NUTclient Discord server and every other service we operate under the NUTclient name (together the "Services").
By downloading, installing or using any part of the Services you confirm that you have read and understood these Terms and that you agree to them. If you do not agree, do not install or use the Services. If you are under the age required to enter into a binding contract in your country, you may only use the Services with the consent of a parent or legal guardian.
NUTclient is not an official Minecraft product. It is not approved by or associated with Mojang Studios, Microsoft Corporation or any of their affiliates. "Minecraft" is a trademark of Mojang Studios. You need a legitimately purchased copy of Minecraft: Java Edition to use the Client.
2. Beta status and changes to the Services
The Services are under active development and are currently offered as a beta. Features may be incomplete, change without notice or be removed. Releases can contain bugs that crash the game, corrupt a world, lose settings or cause other damage. Back up your worlds and instances before using any new version.
We may change, suspend or discontinue any part of the Services at any time, for example for maintenance, security, legal reasons or because a feature is no longer maintained. Where practical we will announce larger changes in advance on our Discord server or in the launcher. We may also change these Terms; the version published on this website applies. If we make a material change, we will point it out in the launcher. If you keep using the Services after a change takes effect, you accept the new Terms.
3. Licence to use the software
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the launcher and the Client on devices you own or control, for your own non-commercial use, for as long as you comply with these Terms.
The software, its source code, artwork, text, icons, logos and other content are owned by us or our licensors and protected by copyright and other laws. Components that we took over from open source projects remain under their own licences; the notices and licence texts are included in the software and in our repositories. Nothing in these Terms limits your rights under those open source licences.
You may not (a) copy, redistribute, sell, rent or sublicense the software except as the applicable licence allows; (b) remove or alter any copyright, trademark or licence notice; (c) use the NUTclient name, logo or branding in a way that suggests an official relationship without our written permission; (d) reverse engineer or decompile the Services where that is prohibited by law and not expressly permitted by an open source licence; or (e) use the Services to build a competing service by scraping or copying our protected content.
4. Accounts, sign-in and security
The launcher signs you in with a Microsoft account to verify that you own Minecraft. We do not see your Microsoft password. The launcher stores the tokens that Microsoft issues for this purpose on your device so that you do not have to sign in on every start. Anyone with access to your computer account may be able to use these tokens. Keep your device secure, log out on shared computers and revoke access in your Microsoft account settings if you suspect misuse.
Some online features (friends, chat, cosmetics, shop, synchronisation, gallery) use a NUTclient account that is linked to your Minecraft profile. You are responsible for everything that happens under your account and for keeping any API key, sync key or code that we give you secret. Tell us immediately if you believe your account has been compromised.
Offline accounts are not supported. Accounts that are banned, or that cannot be verified as owning Minecraft, may be refused access. Access can also be restricted during maintenance or while an allow-list (whitelist) is active for a beta.
5. Acceptable use
You agree not to use the Services to: break the law; harass, threaten, impersonate or discriminate against others; post or share illegal, hateful, sexually explicit, violent or otherwise harmful content; spam, advertise or send unsolicited messages; infringe copyrights, trademarks or privacy rights; spread malware; interfere with, overload or attack our servers, other users or third-party servers; attempt to gain unauthorised access to accounts, data or systems; bypass bans, restrictions, rate limits or technical protections; or manipulate rewards, credits, codes, referral programmes or statistics.
You must follow the rules of every Minecraft server you join. Some modules can give an advantage that a server forbids. Whether a feature is allowed on a server is decided by the server operator, not by us. Server operators can ask us to block modules on their server; we enforce such lists in the Client, but a modified client cannot be guaranteed to respect them. You alone are responsible for any ban or penalty you receive on a server.
We may remove content, restrict features, suspend or terminate accounts, and ban Minecraft profiles from our online services if you violate these Terms or if we reasonably believe that it is necessary to protect users, the Services or third parties. Where reasonable we will tell you why.
6. User content and the community features
Features such as chat, friends, nametags, cosmetics submissions, the gallery and feed, server mappings, tickets and the Discord server allow you to send or publish content. You keep the rights you have in your content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and transmit it as needed to operate and promote the Services (for example to show your post to other users or to display an approved cosmetic).
You confirm that you have all rights needed to submit your content and that it does not violate the law or the rights of others. Posts in the gallery and feed link to media hosted by third parties. We do not store those files and are not responsible for them. We may remove posts and links at any time and will act on notices about unlawful content.
Cosmetics, capes, emotes and similar items that you submit for review may be accepted or rejected at our sole discretion. Accepted items may be made available to other users, and we may edit, rename or withdraw them. Nothing you submit entitles you to payment unless we agree this in writing.
7. Credits, cosmetics, NUT+ and virtual items
Credits, cosmetics, emotes, codes, NUT+ time and similar items are virtual goods with no cash value. They are provided under a limited licence to use them inside the Services, cannot be exchanged for money, and may not be sold or traded outside the Services. We may grant, change, rename or remove such items, for example for balance, fraud prevention or legal reasons.
Where we offer paid products in the future, the price, the payment provider and the applicable withdrawal rights will be shown before you buy. Mandatory consumer rights under the law of your country are not affected by these Terms. At the time of writing, credits and NUT+ are granted by us and are not sold for money.
8. Third-party services and links
The Services connect to third-party services, including Microsoft and Mojang (sign-in and Minecraft services), Modrinth and CurseForge (mods and modpacks), LRCLIB (lyrics), Discord, GitHub, Imgur and other media hosts, Let's Encrypt (certificates) and the operating system's media APIs. Those services have their own terms and privacy policies, and we have no control over them. They may change, become unavailable or reject requests at any time, which can limit features of the Services.
Mods and resource packs you install through the launcher are created by third parties. We do not control or guarantee their content, safety or compatibility. Install only content you trust.
9. Fees
The launcher and the Client are currently free of charge. You are responsible for your own internet connection, device and any costs that your provider charges.
10. Privacy
We process personal data as described in our Privacy Policy, which forms part of these Terms for the purposes of explaining how the Services work. Please read it before you use the online features.
11. No warranty
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability or that the Services will be free from errors, interruptions, bugs or harmful components. We do not promise any specific performance improvement, frame rate or compatibility with any server, mod or hardware.
Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under mandatory law, including consumer protection law in your country.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, lost worlds or settings, loss of accounts or items on third-party servers, or damage to your devices, that arise from or relate to your use of or inability to use the Services, even if we were told that such damage was possible.
Where liability cannot be excluded, our total liability for all claims relating to the Services is limited, to the extent permitted by law, to the amount you paid us for the Services in the twelve months before the event (which is zero for the free Services) or 50 euros, whichever is higher. This limitation does not apply to liability for intent or gross negligence, for injury to life, body or health, under mandatory product liability law, or where the law does not allow a limitation.
13. Indemnity
You agree to indemnify and hold us harmless from claims, damages and costs (including reasonable legal fees) brought by third parties that arise from your breach of these Terms, your content, or your use of the Services in violation of the law or of the rules of a server, to the extent permitted by law.
14. Termination
You can stop using the Services at any time by uninstalling the launcher and the Client. You can ask us to delete your online account and data by contacting us (see the Privacy Policy). We may suspend or end your access as described in section 5, or if we discontinue the Services. Sections that by their nature should survive termination (including 3, 6, 11, 12, 13, 15 and 16) will survive.
After termination you must stop using the software. Open source components may of course continue to be used under their licences.
15. Copyright and takedown notices
If you believe that content on the Services infringes your rights, send us a notice with your contact details, a description of the work and of the allegedly infringing content with its location, a statement that you act in good faith, and a statement that your information is accurate. We will review notices promptly and may remove content and inform the affected user, who may respond.
16. Governing law, disputes and general terms
These Terms are governed by the law of the country in which the operator is established, excluding its conflict-of-law rules, unless mandatory consumer law of your country of residence provides otherwise. If you are a consumer, you also keep the protection of the mandatory provisions of the law of your country. The courts at the operator's seat have jurisdiction, unless mandatory law gives you the right to sue or be sued in the courts of your home country.
If a provision of these Terms is or becomes invalid or unenforceable, the remaining provisions stay in force and the invalid provision is replaced by a valid one that comes closest to its purpose. Our failure to enforce a right is not a waiver. You may not transfer your rights or duties under these Terms without our consent; we may transfer ours to a successor of the project. These Terms (with the Privacy Policy) are the entire agreement between you and us about the Services. Where a translation is provided, the English text prevails in case of conflict, unless mandatory law says otherwise.
